Delhi Sealing : Delhi de-sealing or a political gimmick

All unauthorised construction, which was sealed by Supreme Court in the last couple of years, can begin operations immediately.

On Friday, the centre virtually legalised unauthorised constructions but RWAs say they will appeal to the Supreme Court.

Sheila Dikshit denies that the ban on sealing was motivated by the fact that Delhi will vote later this year. But many disagree.

The representative for the Supreme Court, who ordered the sealing drive has already said the ban on sealing means a free for all.

And now, Resident Welfare Associations say they will appeal to the Supreme Court against the government’s new law.

It is important to remember that the Supreme Court is going to review Delhi’s Master plan on the February 13 that master plan sanctions huge new areas for commercial activity in Delhi something the court has not approved of in the past.

The government might claim to have saved Delhi from the ghost of sealing but not everyone is happy with the Urban Development ministry’s new notification, which effectively ends sealing in the capital.

On the other hand,The government on Saturday said the controversial directives on sealing and demolition issued yesterday were legally valid and asked the civic agencies to implement them.

“I have given directions to three local bodies – MCD, NDMC, and DDA and they have to implement the orders. I have been empowered by Parliament and I have given the directives accordingly.

“These directives are legally valid and the civic agencies have to implement them,” Urban Development Minister Jaipal Reddy told reporters here on Saturday, a day after government notified the civic agencies to stop sealing and demolition of constructions that have come before December 31, 2005.

The minister’s remarks came as the Supreme Court-appointed committee on sealing today said it would study the government’s order suspending action against encroachment and illegal constructions in the national capital.

Rejecting arguments that the Centre’s move to suspend demolition and sealing in the national capital will invite court’s ire, Chief Minister Sheila Dikshit today said the decision was taken considering “ground realities.”

“Court has always held the view that change your laws, nothing should be illegal,” she said and dismissed the opposition charge that the government’s move was a political stunt ahead of assembly elections in Delhi.

A Congress delegation led by Delhi Pradesh Congress Committee President J P Aggarwal on Saturday met Reddy to thank him for giving relief to Delhiites in sealing and demolition drives.

The Supreme Court has criticised the governments efforts to stall the sealing drive through ordinances and notifications. But in a season pregnant with electoral possibilities incurring the wrath of the Supreme Court is perhaps the last thing on the government’s mind.
