HC directed to MCD, DDA for submit records
The Delhi High Court today directed the MCD as well as DDA to submit records relating to the land and flats allotted to people in Kalkaji’s transit camp area, where the DDA recently started sealing flats on the ground of alleged misuse of properties by selling them off.
A Division Bench of Chief Justice M.K. Sharma and Justice Sanjeev Khanna asked both agencies to place the records before it by August 29.
The order came after some of the residents through their counsel claimed before the Bench that the land was allotted to them along with free hold right way back in 1965 by the Central government.
Countering the arguments, the DDA submitted that initially the land was allotted to slum dwellers but in the course of time people started encroaching public land and built permanent structure and subsequently started selling the properties off.
Directing to continue the stay order on eviction and sealing, the Court fixed August 29 as the date for further hearing of the matter The Bench was hearing a petition filed by MLA Subhash Chopra seeking the Court to restrain DDA from sealing the properties and evicting people from their flats as they have been legally staying in the colony
